Despite our sufferings and financial losses, I didn’t want to exercise the option of court, however, now in response to your recent legal notice, I have consulted my lawyer who is preparing a lawsuit claiming compensation for damages (both financial and psychological) incurred due to unexpected long delay of 48 days in fulfilling your commitments.

Initially, I signed the agreement with positive intention to sell my unit and meet my pending payment commitments and family financial emergencies, immediately as promised by the agent. The damages that I discussed with you and the agents in-person and reported through emails and phone calls etc include (but not limited to) delay in my sister’s Ear surgery, my house rental payment and fee payment for my two kids admitted in college of medicines.

In addition, the delay caused cancellation of my unit due to non-payment by AlDar, which was extremely shocking for my family and in order to restore and avoid huge financial losses, I had to sell my family jewelry, borrow funds from the bank and other resources at very high rates.

As per the common practice in the UAE, such transfers are mostly closed within 1-2 weeks max. as it’s just the transfer of file, which doesn't involve huge payments involving bank mortgage, property inspection and municipality approval etc, however, including a 40 working days period in the MoU clearly manifests your intentions from the very beginning.
