Buy a Property in Sharjah – Legal Paperwork
When buying a property in Sharjah, you must be vigilant with the involved legal paperwork. The procedure for purchasing a property in Sharjah begins with:
- Initial approval for the real estate project registration (a form provided by the Sharjah Real Estate Registration Department).
- Obtaining a report from the Planning and Survey Department showing the property’s conformity to the conditions of parcelling and retail sale.
- Fill out a project registration form and sign the undertaking by the owner (a form provided by the Department).
Contracts Required
Dealing with Sharjah real estate requires several contracts and agreements to ensure foolproof property transactions between the involved parties:
- Copy of the contracting agreement.
- Authenticated copy of the marketing contract.
- The initial unified form (a form provided by the Department).
Documents Required
The following are the enlisted documents required by the Sharjah Real Estate Registration Department:
- Copy of the title deed (in the name of the Commercial Licence).
- Copy of the official map of the plot.
- Photocopy of the general plans of the project approved by the competent bodies (on A4 paper).
- Copy of the developer’s passport.
- Copy of the developer’s ID card.
- The building permit was issued by Sharjah Municipality within no less than three months of its issuance.
- Completion certificate from the Emirate’s concerned municipality or the Roads and Transportation Authority.
- The Project Name Approval Certificate by the Municipality for towers or by the Planning and Survey Department for complexes.
- The Commercial Licence and Memorandum of Association of the company.
- A detailed schedule of the units signed and sealed by the developer.
- A detailed schedule of the units and specifications in Excel format (a form provided by the Department).
- Bank guarantee letter (a form provided by the Department).
- A statement of the buyers’ names.
- Acknowledgment receipt of the electrical plans from Sharjah Electricity and Water Authority.
Required Fees
You must pay AED 1,020.50 to complete the property-buying procedure. Also, you must receive the receipt from the Sharjah Real Estate Registration Department.
Departments Involved in the Procedure
The procedure for submitting the contracts and documentation is held in the Sharjah Real Estate Registration Department (SRERD). However, you must receive the respective required documents priorly from the following departments:
- Sharjah Municipality – Building Permit
- Roads and Transportation Authority – Completion certificate
- Planning and Survey Department – Property’s conformity report and Project Name Approval Certificate
- Sharjah Electricity and Water Authority (SEWA) – Acknowledgement receipt of the electrical plans
